The website OrientalDream.it and the brands Oriental Dream and OrientalDream.it are registered trademarks owned by Oriental Dream S.r.l.s. VAT number 10297951211.

By completing the purchase, the customer accepts all present terms and conditions of sale.

Introduction

These terms of sale (hereinafter only "General Conditions") govern the sale of products marketed by www.orientaldream.it. All purchase contracts for products concluded through the website www.orientaldream.it and according to the procedures indicated therein, between the seller and the Customer, will be governed by these General Conditions. All published prices are intended to include VAT.

Acceptance of Terms of Sale

1. The contract between OrientalDream.it and the Customer must be understood as concluded with the acceptance, even partial, of the order by OrientalDream.it, which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated to the Customer in any way. By placing an order in the various ways provided, the Customer declares that they have read all the information provided during the purchase procedure and fully accept the general conditions and payment terms set forth below.

2. If the Customer is a final consumer (i.e., a natural person who purchases goods for purposes not related to their professional activity), once the online purchase procedure is completed, they will print or save an electronic copy and, in any case, keep these general terms of sale, in compliance with articles 3 and 4 of Legislative Decree no. 185/1999 on distance sales.

3. Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order.

Purchase Methods

1. The Customer can only purchase products present in the electronic catalog of OrientalDream.it at the time of order submission and viewable at www.orientaldream.it, as described in the relative information sheets. The technical information inserted on the website www.orientaldream.it faithfully reproduces those of the manufacturers of the goods included in the catalog. OrientalDream.it, therefore, reserves the right to modify the technical information of the products to adapt them to those provided by the manufacturers, without any notice. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics, and may differ in color, size, accessory products present in the figure. All information supporting the purchase (Glossary, Purchase Guide, etc.) is to be understood as simple generic informational material, not referable to the real characteristics of each individual product.

2. The correct receipt of the order is confirmed by OrientalDream.it through an email response, sent to the email address communicated by the Customer. This confirmation message will include the Date and Time of order receipt and a 'Customer Order Number', to be used in any further communication with OrientalDream.it. The message reproduces all data entered by the Customer who undertakes to verify its correctness and to promptly communicate any corrections, according to the methods described in this document. The Customer can also check the status of their order by accessing their dedicated web area under "Order Status".

3. In case of non-acceptance of the order, OrientalDream.it undertakes to promptly communicate to the Customer.

4. The Customer can request cancellation or modification of the order until it is not in the "preparation in progress" status by writing to support@orientaldream.it.

5. All prices on the website are to be understood as public prices and, therefore, including VAT. OrientalDream.it reserves the right to modify prices at any time, without any notice. In the event that an incorrect and/or clearly derisory price is published, for any reason (error in our systems, human error, etc.), the order will be cancelled, even in case of initial validation.

6. On the website www.orientaldream.it the quantities of product available at the time of order are visible. Since the simultaneous access of many user-customers and the simultaneous possibility of "online" orders modify the availability of the product, OrientalDream.it does not guarantee the certainty of assignment of the ordered goods.

7. For certain products, subject to price promotions, OrientalDream.it reserves the right to accept orders by reducing quantities, subject to communication and acceptance by the Customer, in the absence of which the order must be considered cancelled.

Payment Methods

1. In case of purchase by Cash on Delivery, a supplementary contribution of €3 is applied to the total amount of the order, clearly highlighted at the time of choosing the payment method. Cash payment is possible. Cash payment is only possible for orders whose amount is less than €1,000, giving the courier the exact sum.

2. In case of payment by Advance Bank Transfer, the shipment of what was ordered takes place only upon actual credit to the OrientalDream.it bank account, which must occur within 2 working days from the date of order acceptance, after which the order is considered automatically cancelled. The bank transfer reason must include the order identifier that is issued in the order confirmation email. The bank details on which to make transfers are indicated at the conclusion of the order.

3. In cases of purchase of goods with Credit Card payment method, simultaneously with the conclusion of the online transaction, the reference banking institution proceeds to authorize only the commitment of the amount relating to the purchase made. The amount relating to the fulfilled goods is charged to the Customer's credit card at the time of the actual fulfillment of the ordered goods. Accepted credit cards are all those that rely on Visa, Mastercard and American Express circuits. In case of purchase with American Express credit card, the order fulfillment may be delayed due to specific anti-fraud checks on this circuit. Furthermore, we remind you that the destination address of the goods must correspond to that declared at the time of card issuance: otherwise it is necessary to contact the American Express call center to authorize shipment to a different address.

   In case of order cancellation, either by the Customer or in case of non-acceptance by OrientalDream.it, the same will simultaneously request the cancellation of the transaction and the release of the committed amount. Order cancellation is possible until the order is not yet in warehouse preparation. The order status is clearly visible in the "Order Status" area. Release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiration (24th day from the authorization date). Requested cancellation of the transaction, in no case can OrientalDream.it be held responsible for any damages, direct or indirect, caused by delay in the non-release of the committed amount by the banking system.

4. Prepaid Credit Card In case of purchase with Prepaid Credit Card, the Customer enters the card identification numbers; simultaneously with the conclusion of the online transaction, the reference banking institution proceeds to authorize only the commitment relating to the purchase made. The amount relating to the fulfilled goods is charged to the Customer's credit card at the time of the actual fulfillment of the ordered goods. In case of order cancellation, either by the Customer or in case of non-acceptance by OrientalDream.it, the same will simultaneously request the cancellation of the transaction and the release of the committed amount. Order cancellation is possible until the order is not yet in warehouse preparation. The order status is clearly visible in the "Order Status" area. Release times, for some types of cards, depend exclusively on the banking system and can reach their natural expiration (24th day from the authorization date).

5. In case of purchase through PayPal payment method, at the conclusion of the order the Customer is directed to the PayPal login page. The amount relating to the order is charged to the PayPal account at the time of order acquisition. In case of order cancellation, either by the Customer or in case of non-acceptance by OrientalDream.it, the amount will be refunded to the customer's PayPal account. Order cancellation is possible until the order is not yet in warehouse preparation. The order status is clearly visible in the "Order Status" area.

Payment Methods and Order Processing Times

Transaction Security

Online transactions with Credit Card are carried out directly on the Bank's website, through a Secure Server that adopts the SSL (Secure Socket Layer) protection system. This protocol, certified Verisign, allows communication in a mode designed to prevent interception, modification or falsification of information. OrientalDream.it does not become aware of the Credit Card data used by its customers.

Delivery Methods

OrientalDream.it does not ship to Mail Boxes, post offices, post office boxes and to companies that provide domiciliation services. Shipping costs are charged to the Customer and are explicitly highlighted at the time of order placement. Payment for the goods by the Customer will be made using the method chosen at the time of order. No additional expense or commission is due to OrientalDream.it.

The delivery of the ordered goods is understood to be at truck side, unless otherwise specified. The goods travel with packaging made directly by the manufacturer or in customized OrientalDream.it boxes. In no case are other closure materials used. The delivery times of the ordered goods are purely indicative and are published in the appropriate table under "indicative delivery times"; the same may undergo variations due to force majeure or due to traffic conditions and road conditions in general or by act of the Authority. Standard delivery will take place during the following hours: from 9:00 AM to 1:00 PM; from 3:00 PM to 6:00 PM, on all non-holiday days, Monday to Friday. No responsibility can be attributed to OrientalDream.it in case of delay in order fulfillment or delivery of ordered goods.

At the time of delivery of the goods by the courier, the Customer is required to check:

1. that the number of packages being delivered corresponds to what was communicated by the chosen courier;

2. that the packaging appears intact, not damaged, nor wet or, in any case, altered;

3. that the security adhesive tape on the package is intact;

4. any external damage or non-correspondence of the number of packages must be immediately contested to the courier making the delivery, affixing the wording "collection with reservation for damaged package", or "collection with reservation for open package" or "collection with reservation for missing packages";

5. it is also required to open an anomaly case with OrientalDream.it by sending an email to support@orientaldream.it;

6. once the courier's document is signed, the Customer cannot oppose any contestation regarding the external characteristics of what was delivered;

7. even in the presence of intact packaging, the goods must be verified within 3 calendar days from receipt;

8. any hidden damage or anomalies must be reported by writing from the "Contact Us" page or sending an email to support@orientaldream.it within 3 days of receipt of the goods. Any report beyond the above terms will not be taken into consideration;

9. for each declaration, the Customer assumes full responsibility for what is declared.

10. Please note that Amazon Shipping does not require a signature at the time of delivery, therefore it will be considered validated through geolocation and/or proof of delivery provided by Amazon itself.

Processing and Delivery Times

1. "Order processing time" means the time interval that elapses from order receipt to delivery of the product to the courier. All orders, containing products available in stock, for which payment confirmation has been received by 1:00 PM on a working day, are entrusted to the courier the evening of the same day.

2. The table below shows the indicative delivery times expressed in hours from the moment the shipment is taken over by the courier (collection of the shipment at our Logistics Center).

Right of Withdrawal

1. Pursuant to art. 64 et seq. of Legislative Decree no. 206/2005, OrientalDream.It Customers, within 14 days from the purchase date, can decide to withdraw from the purchase made, for any reason and without any penalty, whether they use a Tax Code or a VAT number for the order. In the case where a VAT number is used, withdrawal is only permitted for purchases intended for personal use and not for resale purposes.

2. To return the product, the Customer must open a ticket, or write from the "Site Contacts" section (https://www.orientaldream.it/it/contattaci) in the "Returns and Warranty" section, indicating the order number for which one or more products are intended to be returned. The refund can be made via bank transfer, credit card reversal, PayPal refund or postal money order (in this case, expenses will be charged to the Customer). After sending the request, the Customer will be contacted by customer service within 5 working days, return shipping costs will be charged to the customer, if the customer uses non-tracked transport services, such as priority mail and the shipment should not arrive at our headquarters, there will be no right to refund. The product that must be sent, within 5 days of authorization to the address indicated by customer service, attaching the RMA form provided.

3. The right of withdrawal is subject to the following non-derogable conditions: the Customer must return the product and the gifts inserted in the order, from which the protective plastic must not have been removed. In the case where the protective plastic has been removed, it will no longer be possible to make a return, as the product will no longer be resalable. Furthermore, it is not possible to make returns on products that originally do not have protective plastic, such as Body Sprays or Kalotinis perfumes, as it would not be possible to verify their integrity. The reference legislation states that the right of withdrawal cannot be exercised on sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery.

4. The integrity of the product is under the responsibility of the Customer until OrientalDream.it confirms its receipt.

5. In the case where the product suffers damage during transport, it will be OrientalDream.it's care to communicate the occurrence to the Customer to allow them to file a complaint against the courier chosen by them and obtain reimbursement of the value of the goods, if this is insured; therefore, OrientalDream.it will make the product available to the Customer, canceling the withdrawal.

6. OrientalDream.it will refund the product within 10 days from the date of its return to its warehouse only if the conditions of art. 3 are respected.

7. The right of withdrawal, even if already exercised, lapses if the customer does not return the goods to OrientalDream.it within 5 days of exercising the right of withdrawal. For the purposes of the term expiration, the goods are considered returned at the moment they are delivered to the carrier or forwarder.

8. It is informed that it is the Customer's right to reject the goods at the time of delivery, however, it is pointed out that, upon issuance of the credit note, in case of advance payment (credit card, PayPal, advance bank transfer, postal transfer), shipping costs up to the delivery address indicated by the Customer and those relating to the return of the goods and any additional cost charged by the courier will be reversed. Instead, in the case where the customer who refuses delivery has chosen cash on delivery as the payment method, they will no longer be able to purchase with this method on www.orientaldream.it, but will only be able to purchase using advance payment systems.
